Agreement

These Terms of Service ("Terms") govern your use of Final Eyes, a creative review and approval platform operated by Hard Out Ltd ("we", "us", "our"), a company registered in England and Wales (company number 17267842) with its registered office at Station House, Station Approach, East Horsley, Surrey, KT24 6QX.

By creating an account or accessing Final Eyes at finaleyes.app, you agree to these Terms. If you do not agree, do not use the service. These Terms apply to account holders (project owners) and, where relevant, to reviewers and collaborators who access projects via a shared review link.

The service

Final Eyes is a platform that allows creative professionals to upload images and video files, organise them into projects and folders, and share them with clients, reviewers, and collaborators for structured feedback. Core features include: file uploads (images and video up to 500 MB per file), review portals accessible via a shareable link, reviewer feedback tools (star ratings, written comments, annotation boxes, and freehand drawings), image approval workflows, version management, email invites, real-time feedback notifications, and subscription-based storage tiers.

We reserve the right to modify, suspend, or discontinue any part of the service at any time. Where changes are material, we will provide reasonable notice by email.

Accounts and eligibility

You must be at least 18 years old and capable of entering a legally binding agreement to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you believe your account has been compromised, notify us immediately at hello@finaleyes.app.

One person or legal entity may not maintain more than one free account. Accounts are non-transferable.

Reviewer and collaborator access

Reviewers and collaborators access Final Eyes via a shared review link generated by an account holder. No account is required. By accessing a review portal, reviewers and collaborators agree to these Terms as they apply to their use of the service. Account holders are responsible for the review links they share and for ensuring they share them only with intended recipients.

Reviewers may leave feedback (including ratings, comments, annotation boxes, and freehand drawings) on content they are given access to. This feedback is visible to the account holder and other reviewers on the same project. Collaborators and retouchers may additionally upload files to projects where they have been granted that role by the account holder.

Access to a review portal may be restricted by a project password and/or email verification via a one-time code. Account holders set these controls at their discretion.

Acceptable use

You may use Final Eyes only for lawful purposes and in accordance with these Terms. You must not upload, share, or distribute content that: is illegal, defamatory, obscene, or infringes the intellectual property rights of any third party; contains malicious code, viruses, or any software intended to damage or disrupt systems; violates the privacy rights of any individual, including uploading images or videos of people without appropriate consent; or is otherwise harmful or objectionable.

You must not attempt to gain unauthorised access to any part of the service, reverse engineer the platform, or use automated tools to scrape, crawl, or overload our infrastructure. Abuse of shared review links, including harassment of other reviewers or submission of malicious feedback, is prohibited.

We reserve the right to suspend or terminate any account that we reasonably believe is in breach of these Terms, without prior notice.

Your content

You retain all intellectual property rights in the files you upload and the projects you create. By uploading content to Final Eyes you grant Hard Out Ltd a limited, non-exclusive licence to store, process, and serve that content solely for the purpose of providing the service to you and your reviewers. We do not claim ownership of your content and will not use it for any other purpose.

You are solely responsible for ensuring you have the right to upload and share any content you add to Final Eyes. We are not responsible for content uploaded by you or your collaborators.

Reviewer feedback (comments, annotations, drawings, ratings) is stored and displayed within your project. Account holders can delete reviewers and their associated feedback at any time via the project admin panel.

No AI. Ever.

Final Eyes does not use artificial intelligence or machine learning anywhere on the platform. No AI models are used to analyse, process, tag, categorise, enhance, or interact with your content in any way.

Your uploaded images and videos will never be used to train, fine-tune, or evaluate any AI or machine learning model, by Hard Out Ltd or any third party. Your content will not be shared with, sold to, or licensed to any AI company, dataset provider, or research organisation for any purpose whatsoever.

This is an absolute commitment. It applies to all content uploaded to Final Eyes, regardless of your subscription tier, and will not change without your explicit written consent.

Subscriptions and billing

Final Eyes offers a free tier and paid subscription plans (Solo, Studio, Agency, and Legend). Paid plans unlock higher project limits, increased storage, and additional features. Plan details and pricing are set out on our pricing page and are subject to change with reasonable notice.

Subscriptions are billed on a recurring basis (monthly or annually) via Stripe. Payment is taken at the start of each billing period. Subscriptions renew automatically unless cancelled before the renewal date. You can manage or cancel your subscription at any time from the billing portal within your account settings.

We do not offer refunds for partial billing periods except where required by applicable law. If we discontinue the service, we will provide a pro-rata refund for any unused prepaid period.

Storage limits are enforced server-side. If your storage usage exceeds your plan limit, you will not be able to upload additional files until you upgrade or free up space. We will not delete existing files solely because you exceed your limit.

Support

Support is available via the in-app support ticket system and by email at hello@finaleyes.app. We aim to respond to all enquiries within 2 business days. Support is provided in English.

You may submit feature requests through the in-app feature request system. Submitting a feature request does not create any obligation on our part to implement it.

Intellectual property

The Final Eyes platform, including its design, code, branding, and documentation, is owned by Hard Out Ltd and protected by copyright and other intellectual property laws. Nothing in these Terms grants you any right to use our branding, trademarks, or proprietary technology outside of your normal use of the service.

Uptime and availability

We aim to keep Final Eyes available at all times but do not guarantee uninterrupted access. We may carry out maintenance, apply updates, or experience downtime due to factors outside our control. We will endeavour to schedule maintenance outside of peak hours and to give advance notice of planned downtime where possible.

Limitation of liability

To the fullest extent permitted by law, Hard Out Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, arising from your use of or inability to use Final Eyes.

Our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the greater of (a) the total fees you paid to us in the 12 months preceding the claim, or (b) £100.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

Indemnification

You agree to indemnify and hold harmless Hard Out Ltd, its officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the service, your content, your breach of these Terms, or your violation of any applicable law or the rights of a third party.

Termination

You may close your account at any time by contacting us at hello@finaleyes.app. Upon closure, we will delete your data and uploaded files within 30 days.

We may suspend or terminate your account immediately if you breach these Terms, engage in unlawful activity, or if we are required to do so by law. If we terminate your account without cause, we will provide a pro-rata refund of any prepaid subscription fees.

Governing law and disputes

These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer based in the UK or EU, you may also have the right to use an alternative dispute resolution scheme. More information is available from the Citizens Advice Bureau at citizensadvice.org.uk.

Changes to these terms

We may update these Terms from time to time. We will notify account holders of material changes by email at least 14 days before they take effect. Continued use of Final Eyes after that date constitutes acceptance of the revised Terms.
